The recent unrest prompted calls from some for the declaration of a State of Emergency to enable the state to restore peace and order. Others resisted this call arguing that existing legislative provisions were adequate to deal with the protests, particularly considering that the SANDF had been deployed in co-operation with the SAPS. This Webinar will traverse these issues and try to answer the question: when is a State of Emergency justified in a democratic, constitutional state?
