The Judicial Commission of Inquiry Into Allegations of State Capture, Corruption and Fraud in the Public Sector including Organs of State (Commission), which is chaired by Deputy Chief Justice RMM Zondo, was established to investigate allegations of State Capture, Corruption, Fraud and other allegations in the Public Sector including Organs of State.

In setting up the Zondo commission, the Former President Jacob Zuma was implementing the recommendations by the Public Protector, Advocate Thuli Madonsela. In 2016, Madonsela launched an investigation into state capture after receiving a formal complaint. In her report, following the investigation, she recommended that the president assemble a commission of inquiry into state capture. The Commission is headed by Deputy Chief Justice Raymond Zondo. Most testimony given to the inquiry has focused on allegations of corruption during the administration of former President Jacob Zuma. Due to the volume of testimonies to be heard as well as restrictions associated with COVID-19 pandemic in South Africa, the Commission final report deadline was extended.

Whilst this process has been ongoing, there has been great focus on what the Criminal Justice response ought to be, and in conjunction with this, what level of protection (if any) should be made available for persons who blow the whistle on institutions and individuals who are engaged in corrupt activities.

Objectives:

• Unpack potential findings that the commission could refer to as the commission comes to a close.
• Engage the role of the Criminal Justice system (including the Hawks, and National Prosecuting Authority) in taking forward some of the findings of the commission.

• Engage around the current legislative framework in regard to whistleblowing, and what needs to be done to protect them in an effort to encourage greater cooperation in reducing the incidence of corruption.
